Utah water — surface and underground — is owned by the public. A water right gives a person or entity the right to use a defined volume from a defined source at a defined location. Drilling a well in Utah requires either an existing right, a change application moving an existing right, or (rarely) a new appropriation. Without a water right, a well cannot legally be used.
